Terms of Service
Last updated Effective
These Terms of Service ("Terms") are the rules for using buggs.io: the game at https://buggs.io/play/, our website at https://buggs.io, and our apps for iPhone, iPad, Android and desktop computers when they are available. These Terms are also the end user license agreement (EULA) for those apps.
Please read them. We've tried to keep them short and plain. If you're a parent, the sections on age and minors and purchases matter most. Our Privacy Policy explains what data we handle and why.
Who we are
buggs.io is run by POWERUP GAMING LLC, a limited liability company in TN, United States, doing business as buggs.io. In these Terms, "we", "us" and "our" mean POWERUP GAMING LLC. "You" means the person using buggs.io.
We run the game servers. We also run, or have run for us, our own account and purchase service, called DPS. DPS keeps your player account, coins, items, online progress and purchase records. When these Terms say "the game" or "the service", they mean all of this together: the website, the web game, the apps, the game servers and DPS.
You can reach us at support@buggs.io, by mail at 311 Chimney Rdg, Nolensville TN, 37135, or by phone at 6154269855.
Agreeing to these Terms
By playing, installing one of our apps or buying anything in buggs.io, you agree to these Terms. If you don't agree, please don't use buggs.io. You can read these Terms at any time in the game, under Settings ▸ About ▸ Terms of Service, and every checkout links to them before you pay.
These pages are part of these Terms:
- Purchases, Subscriptions & Refunds, the full rules for coins, items, Premium and refunds.
- Community Guidelines, the rules for nicknames, clubs and fair play.
If one of these pages and the rest of these Terms say different things about the same topic, the page that is more specific about that topic applies, unless the rest of these Terms is better for you.
Rules shown in the game for a specific feature also apply to that feature, for example the details of a season, an event or an offer. If those rules conflict with these Terms, these Terms win, unless the in-game rule is better for you. Our Privacy Policy explains how we handle personal data.
Changes to these Terms
We may update these Terms, for example when we add features, when the law changes, or to make them clearer. The "Last updated" date at the top shows the current version.
If a change materially affects your rights, we'll tell you in the game and on our website (and, for web and desktop Premium subscribers, by email to the address you gave at checkout) at least 30 days before it takes effect. A change needed for legal reasons, or to stop fraud or abuse, may take effect sooner. If you keep using buggs.io after a change takes effect, the new Terms apply to you. If you don't agree with a change, stop using buggs.io and, if you like, delete your account.
A change never applies to a dispute that started before the change. Price changes for Premium follow the rules in Premium subscription.
Age, minors and parents
buggs.io is a general-audience game, made to be suitable for players of all ages.
Players under 13
- You can play for free. A parent or legal guardian should read these Terms with you. By letting you play, they agree to these Terms for you (see "Parents and guardians" below).
- You can't buy anything with real money unless a parent or guardian has first given us verifiable consent. Our support team records that consent. Our Parents' Guide explains how it works.
Players under 18
If you're under 18, or under the age of adulthood where you live, please read these Terms with a parent or guardian, and ask them before you buy anything.
How we learn your age
We don't ask your age to play. The first time you tap something in the lobby that involves buying or a store offer, such as Buy, Start Big, Boost Cubes or a free coin offer, the game asks for your birth year. We store only an age group (child, teen or adult), never the birth year itself. We round toward the younger group to be safe, so a player who turns 13 or 18 this year may be treated as younger. The age group doesn't change by itself as you get older. If you have since turned 13 or 18, or you picked the wrong year, email us. Only our support team can change it. Some changes need a parent or guardian to confirm them first; see Change an age setting.
Protections for younger players
Players we treat as under 18 get extra protections. For example, they have a monthly limit on real-money spending, and they can't spend coins on in-run boosts. The game shows when a limit applies. The Parents' Guide lists all of them.
Parents and guardians
If you let a child use buggs.io, you agree to these Terms on their behalf, and you're responsible for how they use it, including purchases you approve. If a child made a purchase you didn't approve, contact us about web and desktop purchases. For App Store purchases, ask Apple. For Google Play purchases, ask Google first, then us if Google can't help. See Purchases, Subscriptions & Refunds. You can ask to see or delete your child's data by emailing us with their Player ID. See the Parents' Guide.
Your account
No email, no password
You don't sign up with an email address or a password. When you first play, your device creates a random player ID. It stores that ID, and a sign-in key from our account service, on the device. In a web browser they are kept in the browser's storage for our site. That device storage is your account. Your Player ID is shown in Settings ▸ Account.
Recovery codes and transfer codes
Because there is no email, we can't recover an account from a name, an email address or a description. Instead, there are two kinds of code:
- A recovery code (Settings ▸ Account ▸ Recovery code) brings your account back on any device, for example after you lose your device or clear your browser. It is 16 characters long. The game shows it only once: copy it and keep it somewhere safe outside the game. It doesn't expire. Your account has one recovery code at a time, and making a new one ("Replace code") stops the old one working. Each recovery code works once. After you use it, the game asks you to make and save a new one.
- A transfer code (Settings ▸ Account ▸ Transfer code) moves your account to another device right now. It is 8 characters long. You make it on the device that has your account and enter it on the other device. It works once and expires after 15 minutes, so it can't be kept as a backup.
You enter either kind of code on the other device under Settings ▸ Account ▸ Transfer code ▸ Enter code. In the Android app, Restore purchases can also bring back items and subscriptions bought through Google Play, but not coins or other progress. No app store can restore coins: a recovery code or a transfer code brings back your account, with its coins and items, on any device.
If you lose your device, clear your browser's site data, or uninstall the app, and you don't have a recovery code that still works, your account and everything on it, including coins and purchases, may be lost for good. We'll help where we can, but we can't promise to restore a lost account. We keep only a scrambled version of your recovery code, so neither the game nor we can show it to you again. Make a recovery code and keep it safe, especially after you buy something. Write down your Player ID too (Settings ▸ Account): it helps us find your purchases if something goes wrong.
"Erase save" in Settings resets the practice progress saved on your device (device XP, and the level, mastery and stats the game shows as "Practice on this device"), but keeps your account, with its online XP, online level and progress, coins and items. Deleting your account is different; see below.
Keep your codes secret
- A recovery code and a transfer code are each a key to your account. Anyone who enters one can take your account.
- Never give a code to anyone or post it anywhere, not even to us. We will never ask you for one. To confirm that an account is yours, we may ask you to make a new transfer code in the game while we're in touch by email. We can see on our side that a code was made, so you never send it to us.
- Never enter a code someone else gave you. If you do, your purchases and the coins you bought can move to their account.
- A transfer code works only once and expires after 15 minutes. A recovery code works only once and doesn't expire, so keep it as safe as a password.
- If you think someone else has seen your recovery code, make a new one in the game ("Replace code"), which stops the old one working, or email us and we can stop it working.
- A recovery code also stops working when its account is deleted or combined into another account. Wrong codes are limited: after too many failed tries, you have to wait before trying again.
Your Player ID is not a secret. The game uses it, for example, when it loads leaderboards. So your Player ID alone does not prove that an account is yours. Before we delete an account or share its data because someone asked, we may ask for details only the owner would know, such as recent purchases.
Moving and merging accounts
If the device you move to already has its own account, the game shows what will move (for example, purchases, and coins you bought but haven't spent) and what stays behind (for example, coins you earned or were given). It asks you to confirm first. This works the same with a transfer code and with a recovery code. Merges are limited in how often they can happen. The recovery code of the account that is combined into the other one stops working.
No selling or trading
Your account is personal. You may not sell, buy, rent, trade or share accounts, transfer codes, recovery codes, coins or items, or offer to do so, for real money or for anything else. We may close accounts involved in this. Moving your own account between your own devices is fine.
Deleting your account
You can delete your account at any time in Settings ▸ Account ▸ Delete account. If the game says it first needs to confirm that the account is yours, or you can't open the game, email support@buggs.io from any device with your Player ID. Deletion is permanent. The coins, items, online XP and online progress, purchases, Premium benefits and club membership on that account are gone for good. They can't be restored, and they aren't refunded unless the law requires it. Device XP (your practice progress on that device) stays on the device and unlocks nothing online. Online XP belongs to your account. Your settings also stay on your device.
Deleting your account does not cancel a Premium subscription. Cancel it first where you bought it. Our Delete Your Account & Data Requests page explains what we delete, what we must keep, and how long it takes.
Your license to play
buggs.io is free to play. As long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to:
- access and play the game; and
- download and install our apps on devices you own or control,
for your own non-commercial entertainment. You can't sublicense it to anyone. You may share screenshots and videos of your own gameplay, including on channels that earn money. You may not suggest that we endorse you, or use our name or logo as if it were your own.
You may not:
- copy, sell, rent, sublicense or redistribute the game or any part of it;
- reverse engineer, decompile or disassemble the game, except where the law allows it despite this rule;
- modify the game, or use cheats, bots, scripts, macros or other automation to play it;
- interfere with, overload, probe or attack our servers, or get around our security, rate limits or game rules;
- access our services with anything other than our game, website and apps. Light, non-commercial reading of public information, such as public leaderboards, is fine if it doesn't burden our servers;
- use buggs.io or buy anything in it if you're in a country under a US government embargo, or if you're on a US government list of restricted parties;
- use the game in a way that breaks the law.
Some parts of the game are open-source software, such as the Godot Engine. Their own licenses apply to those parts. They are listed on our open-source licenses page, and nothing in these Terms limits your rights under those licenses.
We license the game to you; we don't sell it. This license ends when these Terms end for you.
Nicknames, club names and your content
Right now, the only text you can add to buggs.io is your nickname and, if you create a club, its name. There is no text chat. Club badges and descriptions are chosen from presets.
- Your nickname is public. Other players see it in matches, in join messages, in the kill feed and on leaderboards. It can also appear on club pages and on public leaderboards on our website.
- Don't use your real name, or anything that identifies you, such as your age, school, address, phone number or social media handle.
- Nicknames and club names must follow our Community Guidelines.
You keep any rights you have in what you create. You give us a worldwide, royalty-free, non-exclusive license to store, copy and display your nickname, club name and gameplay (such as scores and match results), as needed to run and show buggs.io. That includes in matches, on leaderboards, on club pages and on our website. This license lasts while the content is in the service, plus the limited time our Privacy Policy describes for logs and records.
We may rename or reset a nickname, rename, hide or remove a club, or remove a score or other content. We may do this at any time and without notice if we reasonably believe it breaks these Terms or our Community Guidelines, is unlawful, or could harm players. Our game servers automatically show "Bug" instead of a nickname our filter finds offensive, or one that several players have reported until a person reviews it, and club names go through some automatic checks. People on our team handle reports and make every other decision to remove or change content. You can appeal a decision by email (see Community Guidelines). We don't review all content in advance, and we aren't responsible for what other players create. You can report it; see Community Guidelines and Help & Contact. Our point of contact for users and authorities under the EU Digital Services Act is support@buggs.io, in English.
Rules of conduct
Play fair and be decent to other players. We have zero tolerance for objectionable content and abusive players. The full rules are in our Community Guidelines, which are part of these Terms. In short, you may not:
- cheat, exploit bugs or glitches, or use modified game clients, bots or automation;
- work with others to manipulate rankings or tournaments, for example by feeding points to another player or club;
- use several accounts to farm rewards, free offers or club points, or to manipulate rankings;
- use a nickname or club name that is hateful, sexual, threatening or harassing, or that pretends to be someone else (including us or our staff), shares personal information or advertises something;
- harass, bully, threaten or target other players;
- scam other players, including tricking anyone into sharing or entering a transfer code or a recovery code;
- sell, buy or trade accounts, codes, coins or items;
- abuse refunds or chargebacks, or pay with a payment method you're not allowed to use;
- break the law or infringe anyone's rights.
If you find a bug or a security problem, please tell us at support@buggs.io instead of using it. Reporting a problem in good faith won't get you in trouble.
Online play, results and availability
Our servers decide
In online matches, our game servers run the game. During a match, your device sends the controls you press, along with details our Privacy Policy describes, such as your nickname and Player ID. The server decides what happens, including movement, eating, kills, scores and results, and its record is final.
We may correct, limit or reject results that look wrong or impossible, come from cheating or a bug, or can't be verified. This can affect scores, leaderboards, coins, stars, online XP and what it unlocks (bugs, power-ups, skins and trails), quests, event progress and club points. If you think we removed something by mistake, email us.
What counts
- Only online matches count toward online rewards and leaderboards: coins, stars, online XP, quests, events and club points. Offline matches don't.
- Your level, each bug's mastery and your records in the game come from your online account and only online matches build them. Device XP stays on the device as practice progress ("Practice on this device") and unlocks nothing online. Online XP belongs to your account. Offline, device XP can open bugs and power-ups for practice against bots on that device only.
- Some modes earn less or don't count toward everything. For example, private party rooms don't count for leaderboards or club points.
Availability and changes
We work to keep the game running, but we don't promise that it will always be available, fast or free of errors. We may pause it for maintenance, updates or problems. Some features need our account service, which may sometimes be unavailable. If it can't be reached, rewards from a match may be added later, or not at all if they can't be verified. If you lose something you paid for because of a problem on our side, email us and we'll make it right where we can.
We may change, add or remove features, modes, items, prices and events. We make these changes for good reasons, for example to fix problems, keep the game fair and balanced, follow the law or improve the game. We won't take away an item you bought, except as these Terms describe (for example after a refund or chargeback, when you delete your account, for cheating or fraud, or if we shut down). If we significantly reduce Premium's benefits, we'll tell you in advance (see Premium subscription). If you're a consumer in the EU or UK and a change makes something you paid for clearly worse, you can end that purchase or subscription within 30 days of the change and get a refund for the part you can no longer use. Older versions of the game may stop working with our servers, so you may need to update to keep playing online. Some items need a newer version of the game. An older version doesn't show or sell them, and an item you bought or were given that your version can't use stays on your account until you update.
If we shut down
If we decide to stop running buggs.io, we'll give at least 30 days' notice in the game and on our website, where we reasonably can. We'll stop selling items before the game closes and stop Premium renewals. For web and desktop subscriptions, we'll refund any period you paid for but can't use. Where the law gives you a right to a refund of other purchases, you keep it. After the game closes, virtual items can no longer be used.
Coins, virtual items and purchases
The full rules are on our Purchases, Subscriptions & Refunds page. Here are the main points.
What you get
- Coins, online XP, species, power-up unlocks, skins, trails, pass tracks, boosts and other virtual items give you a limited license to use them in buggs.io. You don't own them, and they aren't personal property.
- They have no cash value. You can't redeem, sell or exchange them for real money, goods or anything outside the game, and we won't buy them back. The game may show an approximate dollar value next to coin amounts to help you compare prices. That doesn't make coins redeemable.
- Coins and items don't expire while your account exists and the game is running. A season pass track or event access is tied to its season or event, and lasts only as long as that season or event, as shown in the game.
- You can't transfer them to another person. They move between accounts only through the game's own transfer and merge features, under the rules shown there.
- No app store can bring back coins, and Restore purchases (in the Android app) brings back only items and subscriptions. Keep a recovery code for your account, and move your account with a transfer code or your recovery code when you switch devices.
Nothing you pay for is random
We don't sell loot boxes, or any paid item with a random result. Everything you buy shows what you'll get before you pay. Boost Cubes appear at random places in the arena, but you always see a cube's effect before you pay to use it.
How you pay
- Web and desktop: Link, a service of Stripe, sells the purchase to you as the merchant of record. It processes the payment, collects any sales tax and emails your receipt, and the payment terms it shows at checkout also apply. Stripe keeps your card details; we never see your full card number. We deliver what you bought.
- iPhone and iPad: Apple's App Store in-app purchase, under Apple's terms.
- Android: Google Play billing, under Google Play's terms.
The price, what you get, any tax we charge, and for a subscription the billing period are shown before you confirm. Prices, items and offers can change. The end time of a limited-time offer comes from our server. A purchase is complete when the payment provider confirms it to us. We then add what you bought to your account. If you paid and didn't get it, email us.
Refunds
- App Store purchases: Apple handles all refunds under its own process. We can't refund App Store purchases ourselves.
- Google Play purchases: ask Google first, under its refund policies. If Google can't help, email us your Google Play order number and we'll review your request.
- Web and desktop purchases (Link): if something went wrong, for example an accidental or unauthorized purchase, or an item that never arrived, email us within 14 days of the purchase with your Player ID. We review each request case by case. You can also ask Link's support (support.link.com), which may refund a purchase within 60 days in some cases. Whoever refunds it, a refunded purchase is taken back.
- Nothing in these Terms takes away refund rights you have under the law.
If you live in the EU or UK
Consumers in the EU and UK normally have 14 days to withdraw from an online purchase. For purchases on our website or desktop app (sold through Link), coins and items are digital content that we deliver right away. Before you pay for them, the checkout screen says that by paying you agree to immediate delivery, so the EU/UK 14-day right to cancel no longer applies. Your right to withdraw ends once delivery starts, but only if, before paying, you expressly agreed to immediate delivery and acknowledged that you would lose the right, and we confirmed this to you (for example in your receipt). If that didn't happen, you can still withdraw within 14 days of the purchase by emailing us. For App Store and Google Play purchases, Apple's or Google's own withdrawal and refund process applies. Your other rights, such as getting digital content that works as described, are not affected. Subscriptions have their own rules; see Purchases, Subscriptions & Refunds.
Refunds and chargebacks reverse what you got
If a purchase is refunded, reversed or charged back, we remove what it gave you: items, pass tracks and the coins it added. Rewards you already claimed from a pass stay. A refunded Premium payment ends the subscription. If you already spent the coins, your coin balance can go below zero. We call this a debt. While you have a debt you can't spend coins, and coins you earn or buy pay off the debt first. We won't close your account just because you got a refund or made a chargeback.
Premium subscription and auto-renewal
Premium is an optional subscription that renews automatically. The price, billing period and benefits are shown before you buy. By subscribing, you agree to these renewal terms and to the ones shown at checkout.
- It renews until you cancel. At the end of each billing period, Premium renews for another period and the payment method you used is charged the price shown when you subscribed, or a new price we told you about in advance (see "Price and benefit changes" below), until you cancel.
- When you're charged. You're charged when you confirm the purchase, and then for each renewal. The App Store and Google Play may charge a renewal up to 24 hours before the current period ends.
- How to cancel. Cancel where you bought it:
- Web or desktop (Stripe): in the game, go to Settings ▸ Account ▸ Manage subscription. That opens Stripe's customer portal, where you can cancel online straight away. If you can't open the game (for example, you cleared your browser data or deleted your account), you can still cancel online by signing in to Stripe's customer portal with the email address you used at checkout (see How to cancel), or email support@buggs.io with the subject "Cancel Premium" from that address. You don't need to include anything else. (If you can't send from that address, send your receipt instead.) We treat your subscription as cancelled from the day your email reaches us, and if a renewal is charged after that day, we refund it.
- App Store: in your Apple account's subscription settings on your iPhone or iPad.
- Google Play: in the Play Store, under Payments & subscriptions ▸ Subscriptions.
- After you cancel. Premium stays active until the end of the period you've paid for, then stops. We don't refund partial periods, except as described under Refunds or where the law requires.
- Deleting your account doesn't cancel Premium. Cancel it first.
- Free trials. If we offer a free trial, the trial length and the price after it are shown before you start. Unless you cancel before the trial ends (on the App Store and Google Play, at least 24 hours before it ends), the paid subscription starts and you're charged.
- Price and benefit changes. We'll tell you before a new price applies to your subscription, and you can cancel before it does. For App Store and Google Play subscriptions, the store also notifies you, and asks for your consent where its rules require. For web and desktop subscriptions, we'll tell you in the game and by email to the address you gave at checkout. If we remove a major Premium benefit or make another important change to Premium, we'll tell you in advance in the game and, for web and desktop subscriptions, by email to the address you gave at checkout, with how to cancel before the change applies to you.
- Reminders. Where the law requires renewal reminders, we'll send them. For web and desktop subscriptions, we send them to the email address you gave at checkout.
- Family Sharing. Premium and other in-app purchases are not shared through Apple Family Sharing.
More details are on Purchases, Subscriptions & Refunds.
Paid in-run boosts
In some matches you can spend coins on boosts: Start Big (start the match bigger), Revive (keep playing after you're eaten) and Boost Cubes (short arena effects you activate during a match).
- Not in ranked play. Boosts can't be used in ranked matches. We may also keep them out of other modes, such as events. The game shows when a boost can be used.
- Capped. Each boost is limited per match: Start Big and Revive to a set number of uses, and Boost Cubes to a set amount of coins.
- Price first. The coin price is shown every time, before you pay.
- Marked on leaderboards. On open leaderboards, a boosted run is marked as boosted. It only gets a place if your bug grew by at least the normal minimum score beyond the size the boost gave it, and it is then ranked by its full size.
- Final once used. Coins spent on a boost the server applied are not returned. If a boost you paid for in an online match can't be applied, for example because the match ended, the coins come back automatically. That can take up to a few days.
- Offline too. Boosts used in offline matches also cost coins, and those spends are final. Offline matches don't earn online rewards. If an offline Boost Cube you paid for can't start, the game gives the coins back when it can, but it can't always do so.
- Not for minors. Players we treat as under 18, or whose age we don't know yet, can't spend coins on boosts.
Advertising
buggs.io can show ads from Google, so it can stay free to play: short ads between games (never during one), and optional reward ads you choose to watch for a reward named before the ad plays. You get a reward only if the ad plays to its end, once per ad, within the limits the game shows (for example a number per day or per game). A reward ad that doesn't load, or that you close early, gives nothing, and rewards from ads have no cash value, like the rest of the virtual items in these Terms. Players whose age we don't know see no ads. Every ad is non-personalized, and players we treat as under 18 get stricter content limits. No Ads, where sold, and Premium remove the ads between games, never the reward ads. Our Privacy Policy explains what Google receives. Don't try to get rewards without watching the ads, for example with scripts or ad blockers that fake a completed ad: we may withhold or reverse those rewards.
Seasons, passes, events and club tournaments
buggs.io has leaderboards, seasons with passes, time-limited events and weekly club tournaments. These rules apply to all of them, together with the details shown in the game for each one.
In-game rewards only
- Rewards are in-game only: coins, stars, items and similar. There are no cash prizes, gift cards or physical prizes, and rewards have no cash value. They can't be transferred, exchanged or paid out.
- You never have to pay to appear on leaderboards, to play ranked, or to earn points for your club in club tournaments. Every season pass has a free track.
- Some extras need a purchase: the premium track of a pass, and events marked for Premium subscribers or for buyers of a specific item. The game says so on the pass or event before you join.
Schedules can change
Start and end times come from our server and are shown in the game. Leaderboards reset daily, weekly and monthly on US Central time. We may start, extend, pause, reschedule or end early a season, event or tournament, for example because of technical problems, cheating or other abuse. If we end one early, we'll treat players fairly, for example by granting rewards already earned.
Seasons and passes
- Each season runs for the time shown in the game. Free-track rewards you've reached are granted automatically when the season ends.
- Premium-track rewards need the premium track, through a purchase or Premium, before the season ends. If a reward has to be claimed by a deadline, the game shows the deadline when you earn it.
- Stars and other season progress can have limits, such as how many stars you can bank. Anything over a limit is not kept. The game shows the limits.
Club tournaments
- Club tournaments run weekly, from midnight Monday to midnight the next Monday, US Central time. Club members earn points in qualifying online matches. Party room matches don't count.
- Points stay with the club the player was in when the match ended, even if they leave later.
- When the week ends, clubs with points are ranked. Players who are still members when the week ends, and who met the minimum contribution shown in the game, get the reward for their club's rank, if that rank earns one. Each reward is given once.
- Clubs we have hidden, for example for breaking our rules, are not ranked.
Ties
If two players have the same score on a leaderboard, the one who reached it first ranks higher. If two clubs have the same points, the club that reached that total first ranks higher.
Cheating and abuse
If we find cheating, multiple accounts, collusion or other abuse, we may remove scores or points, take a player or club out of the standings, adjust the results, and withhold rewards or take back rewards already granted.
Suspension and termination
You can stop playing at any time. You can also delete your account.
We may limit, suspend or end your access to all or part of buggs.io. For example, we may sign your account out, remove scores, hide or rename your club, or block purchases. We may do this if:
- you break these Terms or our Community Guidelines;
- we reasonably believe you're cheating or committing fraud, or putting other players or the service at risk;
- the law requires it; or
- we stop offering buggs.io (see If we shut down).
We'll act in proportion to the problem. Where it's reasonable, we'll tell you why and give you a chance to respond. If you think we made a mistake, email us.
If we end your access because you broke these Terms, you lose your coins and items, and we don't refund them unless the law requires it. A refund or a chargeback on its own is never a reason for us to close your account. If we end your access, we stop any web or desktop Premium renewal for you. For App Store or Google Play subscriptions, cancel in the store; we'll tell you how. If we end your access for a reason other than your breaking these Terms, we'll refund the unused part of any web or desktop Premium period you paid for.
Parts of these Terms that by their nature should continue after they end will continue. These include the license you gave us for your content, the disclaimers, the limits of liability and the dispute rules.
Our intellectual property and your feedback
buggs.io belongs to us or our licensors and is protected by copyright, trademark and other laws. That includes the game, its code, art, characters, sounds and text, the buggs.io name and logo, and our website. Apart from the license in these Terms and the rights open-source licenses give you, we don't give you any rights in it.
Apple, App Store, Google Play, Google Analytics, Stripe and Cloudflare are trademarks of their owners. Naming them here doesn't mean they sponsor or endorse buggs.io.
If you send us ideas, suggestions or bug reports, we may use them freely, without paying you or crediting you, and we don't have to use them. You keep any rights you have in your feedback. You give us a perpetual, worldwide, royalty-free license to use it.
Third-party services, app stores and payment providers
buggs.io relies on other companies:
- Stripe, through its Link service, is the merchant of record for web and desktop purchases: it sells them to you, processes the payment, handles sales tax, receipts, payment support and disputes, and runs the checkout, order (link.com) and customer portal pages. Stripe's and Link's own terms and privacy policies apply to what you give them, such as your card details, email address, name and billing address.
- Apple (App Store) and Google (Google Play) sell in-app purchases and subscriptions in our apps under their own terms, including their refund rules.
- Cloudflare delivers our website and game traffic and helps protect it from attacks.
- Google (Google Analytics) counts visits to our website pages, not the game, with its advertising features off. Our Privacy Policy explains what it collects and how to switch it off.
- Google (Google AdMob in our apps, Google's H5 Games Ads in the web game) provides the ads in the game, under Google's own policies. Our Privacy Policy explains what it receives.
We aren't responsible for third-party services, websites or apps that we don't control. That includes websites linked from the game or our website, for example in game news. Your use of them is under their terms. You're responsible for any internet or mobile data charges from using buggs.io.
Disclaimers
We work hard to make buggs.io fun and reliable, but it is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the game will be uninterrupted, secure or error-free, or that data, progress or items won't be lost.
Each disclaimer in this section applies only to the extent the law that applies to you allows it. If you're a consumer in the EU, the UK or another country with mandatory consumer guarantees, such as a right to digital content that matches its description and is of satisfactory quality, those rights still apply. Nothing in these Terms limits them.
Limitation of liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages. We are also not liable for loss of profits, revenue, data, goodwill or virtual items, arising from or related to buggs.io or these Terms. This doesn't change what we say in Online play, results and availability about things you paid for that are lost because of a problem on our side; and
- our total liability for all claims about buggs.io or these Terms is limited to the greater of (a) the amount you paid for buggs.io purchases in the 12 months before the event that led to the claim, and (b) US$50.
These limits apply whatever the legal theory, whether contract, tort (including negligence) or anything else, and even if we were told that the damage was possible.
These limits don't apply to liability that can't be limited by law. That includes liability for death or personal injury caused by our negligence, for fraud, and your statutory rights as a consumer. Each limit in this section applies only to the extent the law that applies to you allows it. If you're a consumer in the EU or UK, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill.
Indemnity
Someone else might make a claim against us because you broke these Terms or the law, or infringed someone's rights, through your use of buggs.io. An example would be a club name that infringes a trademark. In that case, you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees, to the extent you caused them. This doesn't apply to the extent we caused the claim. It applies only to the extent the law that applies to you allows it. We'll tell you promptly about any such claim and let you take part in responding to it.
Governing law and disputes
Talk to us first
Most problems can be solved quickly. Please email support@buggs.io first, describe the problem and include your Player ID. We'll try to resolve it within 30 days. You can still go to small claims court or a consumer protection authority at any time.
Governing law
These Terms, and any dispute about them or about buggs.io, are governed by the laws of TN and applicable US federal law, without regard to conflict-of-law rules.
Where disputes are decided
Disputes will be decided by the state or federal courts located in Rutherford, TN, and you and we agree to those courts' jurisdiction, except as described below. Either of us may instead bring a claim in a small claims court that has jurisdiction, including in the county where you live.
No arbitration, no class action waiver
These Terms don't require arbitration. They don't take away your right to bring or join a class action, or your right to a jury trial.
Your local consumer rights
If you're a consumer, you also keep the protection of any law of the US state or country where you live that can't be waived by contract. Nothing in these Terms affects those rights. If you live in the EU, the UK or Switzerland, you may bring a claim in the courts where you live, and we can bring a claim against you only in those courts.
Copyright complaints
We respect other people's rights. If you believe something in buggs.io, such as a nickname or club name, infringes your copyright, email a notice to support@buggs.io with the subject "Copyright notice". You can also mail it to POWERUP GAMING LLC, 311 Chimney Rdg, Nolensville TN, 37135. The notice must include:
- your physical or electronic signature, or that of a person authorized to act for the copyright owner;
- a description of the copyrighted work you believe is infringed;
- where the material is in buggs.io, with enough detail for us to find it, such as the nickname or club name and where and when you saw it;
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
Counter-notice. If we removed something of yours and you believe this was a mistake or a misidentification, you can send a counter-notice to the same address. It must include:
- your signature;
- what was removed and where it was;
- a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
- your name, address and phone number; and
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you live outside the US, any judicial district where we can be found), and that you will accept service of process from the person who sent the original notice.
We may pass a notice on to the player concerned. Knowingly false claims can make the sender liable for damages. Where appropriate, we'll end the accounts of players who repeatedly infringe. Send other intellectual property complaints, such as trademark complaints, to the same address.
Additional terms for apps from Apple's App Store
If you got our app from Apple's App Store, these extra terms also apply. If they conflict with the rest of these Terms, these terms win for that app.
- Agreement with us, not Apple. These Terms are between you and POWERUP GAMING LLC only, not Apple. We, not Apple, are solely responsible for the app and its content. These Terms can't set usage rules for the app that conflict with the Apple Media Services Terms and Conditions in effect on the date you accept these Terms.
- Scope of license. Your license to the app is a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. Our in-app purchases and Premium are not shared through Family Sharing.
- Maintenance and support. We are solely responsible for maintenance and support of the app, as described in these Terms or as required by law. Apple has no obligation at all to provide maintenance or support for the app. For help, email support@buggs.io or see Help & Contact.
- Warranty. We are solely responsible for any product warranties, express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if there was one. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party about the app or your possession and use of it. That includes (a) product liability claims; (b) any claim that the app fails to conform to an applicable legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws. These Terms don't limit our liability to you beyond what applicable law allows.
- Intellectual property claims. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a US Government embargo, or that the US Government has designated as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
- Developer name and address. Please send questions, complaints or claims about the app to POWERUP GAMING LLC (doing business as buggs.io), 311 Chimney Rdg, Nolensville TN, 37135, telephone 6154269855, email support@buggs.io.
- Third-party terms. When you use the app, you must follow any third-party terms that apply, such as your mobile data or internet service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
Purchases made through the App Store are processed by Apple. Apple handles their billing and refunds.
Additional terms for Google Play
If you got our app from Google Play, these Terms are between you and us, not Google, and Google isn't responsible for the app or its support. Your use of Google Play, and purchases you make through Google Play billing, are also subject to the Google Play Terms of Service and Google's payment terms and refund policies. If these Terms conflict with Google Play's terms about a purchase made through Google Play, Google Play's terms apply to that purchase to the extent of the conflict.
General terms
- Entire agreement
- These Terms, together with the pages they make part of these Terms and the rules shown in the game for specific features, are the whole agreement between you and us about buggs.io.
- Severability
- If a court finds part of these Terms unenforceable, that part is changed only as much as needed to make it enforceable, or removed, and the rest stays in effect.
- No waiver
- If we don't enforce a term right away, we can still enforce it later.
- Assignment
- You can't transfer your rights or obligations under these Terms to anyone else. We may transfer ours to someone who takes over buggs.io, such as a company we set up to run it, or a buyer. Your rights under these Terms won't be reduced because of the transfer, and we'll tell you if it happens.
- Events beyond our control
- We aren't responsible for delays or failures caused by events we can't reasonably control. Examples are power or internet outages, failures at our service providers, natural disasters and government action.
- Notices
- We may send you notices in the game, on our website, or, for web and desktop purchases, by email to the address you gave at checkout. You can send notices to us at support@buggs.io or by mail to POWERUP GAMING LLC, 311 Chimney Rdg, Nolensville TN, 37135.
- No other beneficiaries
- Except for Apple, as described above, no one other than you and us has rights under these Terms.
- Language and headings
- These Terms are written in English. If we provide a translation, the English version controls where the law allows. Headings and the "In short" summary are there to help you read. They don't change the meaning of these Terms.
